Terms of Service

These Terms govern access to and use of the ARFORTI website (the “Site”), use of customer accounts, and transactions involving products offered through the Site (each, a “Product”).
By accessing or using the Site, you agree to the provisions of these Terms governing use of the Site. By submitting an order (an “Order”), you agree to these Terms and the Shipping Policy, Returns Policy, and Craftsmanship Warranty and Repair Policy in effect when the Order is submitted.
The Privacy Policy separately explains how ARFORTI handles personal information.
1. Eligibility and Accounts
You must have the legal capacity to enter into a contract and must ensure that the account, payment, and shipping information you provide is true, accurate, and complete.
You are responsible for safeguarding your account login information and must promptly contact ARFORTI if you become aware of any unauthorized access or use.
You may not use the Site for commercial resale or other commercial activities without ARFORTI’s written authorization.
2. Site Use and Intellectual Property
The ARFORTI name and marks, and all text, images, video, Product designs, layouts, and other content on the Site, are owned by ARFORTI or the applicable rights holder.
You may access and use the Site only for personal, noncommercial purposes. Without authorization, you may not copy, modify, scrape, publish, sell, or otherwise commercially exploit any Site content.
You may not use the Site in a fraudulent or unlawful manner or in any way that infringes the rights of others. You may not interfere with the operation of the Site, circumvent security measures, gain unauthorized access to any system, or introduce malicious code.
The Site is provided on an “as available” basis. ARFORTI may restrict, suspend, or modify Site functionality for maintenance, security, or operational reasons. ARFORTI does not warrant that the Site will always be uninterrupted or entirely error-free.
3. Product Information and Availability
The material Product information applicable to an Order is the information shown on the Product page and at checkout when the Order is submitted, together with the applicable Order Confirmation.
Reasonable variations in grain, tone, and feel resulting from photography, display devices, and the inherent characteristics of leather are normal variations in material and presentation.
Product selection, availability, and pricing may change before an Order is confirmed. Adding a Product to your shopping bag does not reserve it or mean that ARFORTI has accepted an Order for it.
4. Prices and Payment
The Product price, taxes, shipping charges, and total amount applicable to an Order are those displayed at checkout when the Order is submitted.
Available payment methods are those offered at checkout at that time.
A payment authorization or charge, or an order acknowledgment, means only that the Order has been submitted or the payment is being processed. It does not mean that ARFORTI has accepted the Order.
5. Order Acceptance, Contract Formation, and Termination
By submitting an Order, you make an offer to purchase from ARFORTI.
ARFORTI accepts the Order by sending you a clear order confirmation (the “Order Confirmation”), at which point a contract is formed for the relevant Products. The contract applies only to the Products listed in the Order Confirmation. Products included in the same Order may be confirmed and fulfilled separately.
Before sending an Order Confirmation, ARFORTI may decline or limit an Order on reasonable grounds. After an Order Confirmation has been sent and before delivery, if any of the following circumstances materially affects performance, transaction security, or legal compliance, ARFORTI may cancel the Order and unilaterally terminate all or part of the related contract:
- A Product, leather, hardware, or other required material is unavailable, or the Product cannot be completed in accordance with the Order;
- There is an obvious and material error in the price, taxes, discount, inventory, Product information, or system information;
- Payment is not authorized, is reversed or invalidated, or cannot be completed;
- The Order information, identity information, or delivery address cannot reasonably be verified, or the address cannot be serviced;
- The Order involves fraud, unauthorized use of a payment method, unlawful activity, or sanctions-related restrictions;
- The quantity or frequency of Orders, or other circumstances, reasonably indicates unauthorized commercial resale or abuse of the Site or its services;
- Legal, regulatory, import, export, or carrier restrictions prevent fulfillment;
- An event described in Section 11 affects fulfillment; or
- Other circumstances comparable in nature and effect make performance unlawful or impossible, or prevent completion within a reasonable time.
If ARFORTI declines or cancels an Order, or terminates all or part of a contract, ARFORTI will notify you and refund any amount collected for the affected portion to the original payment method.
For a contract that has already been formed, ARFORTI’s cancellation notice constitutes unilateral termination of the affected portion. Once the applicable refund has been issued, no further performance will be required with respect to that portion.
6. Shipping, Title, and Risk of Loss
Order preparation, production, shipment, tracking, shipping charges, address changes, delays, and other delivery arrangements are governed by the Shipping Policy in effect when the Order is submitted.
Preparation and delivery timeframes shown on the Site are estimates and may vary based on Order scheduling, the atelier’s production schedule, the destination, and carrier conditions.
Title to a Product passes only after ARFORTI has received payment in full and the Product has been delivered. Risk of loss or damage passes when you or your designated recipient takes physical possession of the Product.
Any handling arrangements and charges resulting from incorrect or incomplete shipping information, refusal of delivery, or repeated unsuccessful delivery attempts will be governed by the Shipping Policy.
7. Cancellations, Returns, Warranty, and Repairs
Order cancellations, voluntary returns, return conditions, inspections, fees, and refund methods are governed by the Returns Policy in effect when the Order is submitted.
ARFORTI will determine whether a return qualifies under the Returns Policy based on the actual condition of the returned Product, the Order records, and the applicable Returns Policy. A Product that does not meet the voluntary return conditions is not eligible for a refund under that policy.
ARFORTI may verify any Product returned or submitted for repair against the Order records and Product identifiers. If ARFORTI has reasonable grounds to determine that a Product is not an ARFORTI Product, does not correspond to the original Order, or has been substituted, ARFORTI may deny the corresponding refund under the Returns Policy or repair service.
Warranty and repair services are governed by the Craftsmanship Warranty and Repair Policy in effect when the Order is submitted.
8. Third-Party Websites and Services
Payment, shipping, tracking, and other features may be provided by third parties and may also be subject to their own terms.
Third-party links are provided for convenience only and do not constitute ARFORTI’s endorsement of all content, decisions, or independent actions of those third parties.
To the extent permitted by applicable law, ARFORTI is not responsible for third-party websites, content, decisions, or processing activities beyond its reasonable control. This Section does not alter the transfer of risk under Section 6 or reduce ARFORTI’s obligations under a confirmed Order.
9. Electronic Communications and Transaction Records
Confirmations and notices relating to accounts, Orders, payments, shipping, returns, warranties, and Site security may be provided by email, through the account page, or through the Advisor.
You are responsible for ensuring that your contact information is accurate and for keeping it up to date.
Order Confirmations, payment records, and related communications may serve as evidence of the terms and timing of a transaction. Obvious errors will be addressed only in accordance with Section 5.
10. Limitation of Liability
To the fullest extent permitted by applicable law, ARFORTI will not be liable for:
- Damages not directly caused by ARFORTI’s breach of these Terms;
- Damages that were not reasonably foreseeable when the contract was formed;
- Indirect or consequential damages; or
- Lost profits, revenue, or business opportunities arising from commercial use or resale.
For liability arising out of or relating to a specific Order that may lawfully be limited, ARFORTI’s aggregate liability will not exceed the amount actually paid for that Order.
This Section does not alter any refund, return, or repair arrangements expressly provided under these Terms or the applicable policies, or the transfer of risk under Section 6. This Section does not exclude or limit any liability that cannot lawfully be excluded or limited.
11. Events Beyond ARFORTI’s Reasonable Control
If performance is affected by a natural disaster, war, government action, a major transportation or customs disruption, a failure of a critical network or service provider, or another event beyond ARFORTI’s reasonable control, the affected obligations may be suspended or the time for performance extended to the extent of the event’s actual impact.
If the affected portion of an Order cannot be performed within a reasonable time, ARFORTI may terminate that portion and refund any amounts collected for it.
12. Relationship Among Documents, Updates, and General Provisions
These Terms, the applicable Product page and checkout information shown when the Order is submitted, the Order Confirmation, and the applicable policies together constitute the agreement governing the Order.
For a specific Order, the Order Confirmation and the information expressly presented at checkout will control over general provisions. The Shipping Policy, Returns Policy, and Craftsmanship Warranty and Repair Policy will govern their respective subject matter.
ARFORTI may update these Terms and the applicable policies. An updated version will apply only to use of the Site and new Orders submitted after its effective date and will not retroactively change any previously confirmed Order.
A party’s failure to exercise a right immediately does not waive that right. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
You may not assign any rights or obligations under an Order without ARFORTI’s consent. ARFORTI may assign the related rights and obligations to an affiliate or successor that assumes the relevant business.
These Terms do not confer any rights on any third party.
13. Governing Law and Contact
To the extent permitted by applicable law, these Terms and related Orders are governed by the laws of the Hong Kong Special Administrative Region. Any related disputes are subject to the jurisdiction of the courts of the Hong Kong Special Administrative Region.
