Welcome to the ARFORTI digital atelier. These terms define the covenant between you and the house — from the moment you browse this site to the moment a piece crosses oceans into your hands. Though a legally binding contract, we have written it in plain, honest language. By ordering, registering or otherwise interacting with this site, you confirm your acceptance of these terms and of the Shipping, Returns and Privacy policies they incorporate. This site and the pieces it presents are operated and offered solely by ARFORTI (business address: 103 Wai Yip Street, Kwun Tong, Hong Kong). Every contract of sale you conclude here names ARFORTI as the sole seller. By using this site you confirm you have reached the age of majority in your jurisdiction (or act with a guardian's consent and supervision). We reserve the right to decline service on reasonable grounds; you undertake never to use our works or this digital service for any unlawful or unauthorised purpose, nor to transmit malicious code.
Hand stitching and full-grain leather guarantee that every ARFORTI carries a life of its own — subtle variances of grain and tone are the credential of haute craftsmanship, never a defect. We labour to keep this site precise, yet prices and styles may change, and occasional typographical slips may occur, without prior notice. Where a price is in manifest commercial error, we reserve the right to cancel the order before dispatch with a full refund. But rest assured: apart from such extreme error, the price and style at the moment you order are the unalterable covenant of your order.
Your submission at checkout constitutes an offer to purchase; payment is taken in full at that moment, as the atelier immediately reserves your materials. The contract itself is formed when the atelier formally schedules production (typically 24 hours after ordering — dovetailing precisely with your 24-hour free cancellation right). For the rare high-risk fraudulent order or unreachable address, we reserve the right to restrict or refuse the transaction. Title passes to you upon payment in full; the risk of loss in transit is carried entirely by us until the parcel is delivered (per the carrier's record). In events of force majeure (extreme natural events, customs blockage), we are relieved of liability for delay; should delay exceed 60 days, you may cancel with a full refund.
For clients in the EU and UK, the law additionally grants a statutory right of withdrawal within 14 days of receipt, no reason required. To exercise it, write to your advisor; within 14 days of receiving the returned piece (or proof of its dispatch), we will refund the full amount (including standard shipping) to your original payment method, with return carriage at your cost. This statutory right runs in parallel with our more generous 30-day returns policy — the choice is freely yours.
Every visual and digital asset flowing through this site — the ARFORTI mark, macro photography, design drafts, and typography — is guarded by international copyright and trademark law. Your appreciation and personal collection are most welcome; unauthorised commercial scraping, reproduction, derivative use or profit-making will face rigorous enforcement.
Your account is your private bridge to the atelier — please guard your credentials. Where you generously leave reviews, suggestions or images, you grant us a free, unrestricted licence to display and edit them across the house's media. We undertake never to abuse this licence, and to guard your information strictly under the Privacy Policy. Each electronic communication between us (email included) satisfies every legal requirement of "written form".
To complete transactions you may use third-party tools (payment gateways, logistics tracking), offered "as is" — please weigh their risk yourself. It is strictly forbidden to use this site for network attack, data theft, fraud, harassment, discrimination or the spread of malicious code; offending accounts will be terminated without hesitation, with all rights of action reserved. Further, should your breach of these terms or infringement of any third party's rights expose us to claims, you agree to defend ARFORTI, its affiliates, directors and employees, and to bear all resulting losses, including reasonable attorneys' fees.
To the fullest extent applicable law allows, this site and its works are provided "as is", without implied warranties beyond our express terms. We accept no liability beyond legal bounds for indirect, incidental or punitive losses (such as lost profits) arising from use of this site or purchase of our works; our total liability to you is capped, absolutely, at the amount you actually paid for the disputed order. Nothing here diminishes the mandatory consumer rights your jurisdiction grants and forbids contracting away — where conflict arises, your statutory rights prevail, naturally.
These terms are governed exclusively by, and construed under, the laws of the Hong Kong SAR (save for statutory consumer rights of your home jurisdiction that cannot be excluded). For clients residing in the United States: both parties agree to seek resolution first through good-faith negotiation; failing that, disputes shall be submitted to binding individual arbitration before the American Arbitration Association under its Consumer Arbitration Rules (your right to small-claims court is preserved), and both parties waive participation in class actions; the making, interpretation and enforcement of this arbitration clause are governed by the U.S. Federal Arbitration Act. US clients may opt out of this arbitration clause by writing to us within 30 days of their first order, without prejudice to any other right under their order. Save for matters bound to arbitration, all disputes fall under the exclusive jurisdiction of the courts of the Hong Kong SAR.
These terms, with the policies they incorporate, form the entire digital covenant between you and ARFORTI. Should any clause be held invalid, the force of the rest stands undiminished. Without our written consent you may not assign your rights and obligations hereunder; we may assign ours to an affiliate or business successor, never to the diminution of your existing rights. These terms confer rights on no third party. Should you materially breach them, we reserve the right to terminate your access at any time; obligations already accrued survive termination. We may revise these terms from time to time, effective upon publication — yet the version standing on the day you order is, always, the steadfast covenant of that order.
